Terms of Service
Please read these Terms of Service (“Terms”) carefully before using the FurmBase website and platform (the “Service”) operated by FurmBase (“us,” “we,” or “our”) at furmbase.com. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.
1. Agreement to Terms
These Terms constitute a legally binding agreement between you and FurmBase. By creating an account or using the Service in any way, you confirm that you are at least 13 years of age (or the applicable age of digital consent in your jurisdiction), have the legal capacity to enter into this agreement, and accept these Terms in full.
2. Description of Service
FurmBase provides an AI-assisted form builder that lets you create, publish, and share forms, collect responses and file uploads, accept payments from the people who fill in your forms, analyze responses, and export or sync data to third-party services such as Google Sheets. Which features are available to you depends on your subscription plan.
Two different kinds of payment happen on FurmBase, and they are governed by different sections of these Terms:
- Subscription fees that you pay us for a paid plan — see Section 8.
- Payments collected through your forms, which the people filling in your form pay to you — see Section 9 and Section 10.
3. Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account at furmbase@outlook.com
We record the devices and locations used to sign in to your account so we can alert you to access you may not recognize. This is described in our Privacy Policy.
We reserve the right to refuse registration or cancel accounts at our discretion, particularly if you provide false information or violate these Terms.
4. Acceptable Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates applicable local, national, or international law or regulation
- To exploit, harm, or attempt to exploit or harm minors in any way
- To transmit unsolicited commercial communications, spam, or chain letters
- To impersonate any person or entity, or falsely represent your affiliation with any person or entity
- To collect or harvest personal data from other users without their consent
- To upload, transmit, or distribute malware, viruses, or any other harmful code
- To attempt to gain unauthorized access to any part of the Service or its related systems
- To interfere with or disrupt the integrity or performance of the Service
- For any fraudulent or deceptive purpose
- To collect payments for goods or services you cannot or do not intend to deliver, or for anything prohibited by our payment processor
5. User Content
The Service allows you to create, upload, store, and share content such as forms, questions, images, uploaded files, and collected responses (“User Content”). You retain ownership of your User Content. By using the Service, you grant FurmBase a limited, non-exclusive, royalty-free license to host, store, and process your User Content solely to provide and improve the Service.
You are solely responsible for ensuring your User Content:
- Does not violate any applicable law or regulation
- Does not infringe any third-party intellectual property rights
- Is collected in compliance with all applicable privacy laws (including obtaining proper consent from form respondents)
You are the controller of your form responses. The people who fill in your forms are giving their information to you, not to us — we host and process it on your behalf. If a respondent asks to access, correct, or delete what they submitted, that request is yours to answer. You are responsible for telling respondents what you collect and why.
6. AI Features
Some FurmBase features are powered by third-party AI providers — for example, generating a form from a description, or summarizing and analyzing your responses.
When you use one of these features, the relevant content — your prompt, your form structure, or the responses being analyzed — is sent to that provider to produce the result. This happens only when you ask for it; we do not send your data to an AI provider in the background. Do not run AI analysis on responses containing information you are not permitted to share with a third-party processor.
AI output can be wrong. Anything the AI generates or concludes is a starting point for your judgment, not advice you should rely on without checking. You remain responsible for any form you publish and any decision you make from an AI summary.
7. Third-Party Services
Running the Service depends on third parties — including providers of hosting and data storage, payment processing, email delivery, AI features, and customer support. The categories we use, and what each one receives, are described in our Privacy Policy.
When you connect a third-party account, such as Google Sheets or Google Drive, you authorize FurmBase to access it solely for the purposes described in our Privacy Policy and only to the extent of the scopes you approve. You can disconnect any integration at any time from your account settings.
Your use of third-party services is also subject to their own terms and privacy policies. FurmBase is not responsible for their practices, availability, or outages.
8. Subscriptions and Billing
Some features require a paid subscription. By subscribing you agree to pay the applicable fees. Subscriptions are billed monthly, in advance, through our payment processor. We do not currently offer annual billing.
Automatic renewal. Paid plans renew automatically each month. Where you have authorized it, we charge the payment method saved with our processor. We email you before a renewal is due. If a renewal charge fails, your account is moved to the Free plan and your data is kept.
Free trials. If your plan includes a trial, we email you before it expires. When a trial ends without payment, the account moves to the Free plan.
Cancelling. You can cancel a subscription at any time from your account settings. Cancellation stops future renewals; it does not delete your account. Deleting your account is separate and is described in Section 15.
Subscription refunds. Subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, email furmbase@outlook.com and we will review it.
We may change our pricing at any time and will give reasonable advance notice. Continuing to use the Service after a price change takes effect means you accept the new pricing.
9. Payments Collected Through Your Forms
If you add a payment question to a form, the person filling it in pays at the point of submission. This section explains exactly how that money moves, because it matters.
How the money flows. The payment is handled by our third-party payment processor. Settled funds are received into FurmBase’s merchant account with that processor, and we then record the amount due to you as a balance in your FurmBase wallet. We pay that balance out to you when you request a withdrawal, as described in Section 10.
What this means. Your wallet balance is an amount FurmBase owes you. It is a record in our systems, not money held in a separate account in your name. FurmBase is not a bank and is not a licensed deposit-taker; your balance is not a deposit and is not insured or guaranteed by any deposit protection scheme. We do not pay interest on balances.
The amount charged. The amount a respondent pays is calculated on our servers from the form as you saved it, not from anything sent by the respondent’s browser. If a form contains more than one payment question, each is charged as a separate payment.
Your responsibilities. You are the seller in any transaction collected through your form. You are responsible for delivering whatever the respondent paid for, for describing it accurately, for your own tax obligations on that income, and for any licence or registration your activity requires. FurmBase is not a party to the agreement between you and your respondent.
Fees. Payment processing fees, and any FurmBase fee disclosed on our pricing page, may be deducted before an amount is credited to your wallet or paid out to you.
Holds. We may withhold, delay, or reverse a credit where we reasonably suspect fraud, where a payment is reversed by the processor or the payer’s bank, where we are required to by law, or where you are in breach of these Terms.
10. Wallet Balance and Withdrawals
To receive money you must connect a payout destination (such as a bank account) in your account settings. You are responsible for the accuracy of those details. We are not liable for funds sent to an account you entered incorrectly.
How a withdrawal works. You request a withdrawal from your dashboard. Requests are reviewed and approved before payment, and we may confirm the request with a one-time code sent to you. Funds tied up in a pending request are reserved and are not available to request again. Once approved, we pay the amount to your connected destination.
Timing. Withdrawals are not instant. Review and settlement times depend on the processor and your bank. We do not guarantee a specific payout time.
Your balance does not expire. We do not forfeit, expire, or absorb a wallet balance — including while an account deletion request is open. See Section 15.
Refunds and chargebacks on form payments. FurmBase does not currently provide an automated way to refund a payment collected through a form. If a respondent needs a refund, contact us at furmbase@outlook.com and we will work with you and the payment processor to resolve it. Where a payment is reversed by the processor or the payer’s bank after it has been credited to you, we may deduct the reversed amount from your wallet balance, and if your balance is insufficient, recover it from you.
11. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of FurmBase and its licensors. The FurmBase name, logo, and all related trademarks are trademarks of FurmBase. You may not use our trademarks without our prior written consent.
12. Service Availability
We do not offer a guaranteed uptime commitment or service level agreement on our standard plans. We may change, suspend, or discontinue any part of the Service, and we will give reasonable notice of material changes where we can.
13. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
14. Limitation of Liability
To the fullest extent permitted by applicable law, FurmBase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits our obligation to pay you a wallet balance properly due to you.
15. Account Deletion and Termination
Deleting your account is a request, not an instant action. We built it this way deliberately, because accounts on FurmBase can hold money and run live forms that are still taking payments.
When you submit a deletion request:
- Your account is locked immediately. You can still sign in, but only to see the deletion screen and cancel the request — that is the only way back in, which is why sign-in keeps working.
- A 30-day window opens. We show you how many days remain, and we email you a reminder roughly a week before the date and a final warning the day before.
- You can cancel at any time, during the 30 days or after, and your account is fully restored. Nothing is lost. We keep a record that the request was made and cancelled.
If the 30 days pass and you have not cancelled:
- Any published forms are unpublished so they stop accepting new responses and payments. They are moved back to draft, not deleted.
- The request is placed on hold and passed to our team for review.
- Nothing is deleted automatically. The 30 days are your window to act, not a countdown to erasure.
Your money is never forfeited. If you have a wallet balance, it is held for you. It does not expire and we do not absorb it. Unpublishing your forms at day 30 exists to stop new payments arriving so the amount owed to you becomes final and can be settled. We will not automatically send funds to a payout destination that may be out of date — you withdraw them.
To complete deletion: withdraw any remaining balance, then email furmbase@outlook.com. Final deletion is carried out by our team after that request. Note that cancelling a deletion request does not automatically republish forms that were taken offline — putting a payment form back online is your decision to make.
Termination by us. We may suspend or terminate your account without prior notice if you breach these Terms or if we reasonably believe your actions pose a risk to other users, to respondents, or to the integrity of the Service. Suspension for suspected fraud does not extinguish a balance genuinely owed to you.
After deletion we may retain limited records where required for security, fraud prevention, legal, tax, accounting, or payment compliance purposes.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration or in the courts of competent jurisdiction, as applicable.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and email every FurmBase account holder to let them know, with a link to this page and to our Privacy Policy so you can read what changed for yourself. The same applies to material changes to the Privacy Policy.
Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of those changes.
